MyPetToonTerms of Service
1. Purpose
These terms set out the conditions for using MyPetToon (mypettoon.com, the “Service”), operated by Making Soul Studio (the “Company”), and the rights and duties of the Company and its users.
2. The Service
The Service lets you create pet profiles that turn photos of your pet into a character drawing, turn a story you write into the script and pictures (cover and panels) of an Instagram comic, redraw any panel or edit its text, and download the pictures with the text on them. The Service is used with an account you sign in to with Google.
Scripts are written by generative artificial intelligence (Anthropic’s Claude) and pictures are drawn by generative artificial intelligence (OpenAI); the results are AI-generated. Under Article 31 of the Korean AI Basic Act, we tell you this on screen before you generate, and we label AI-made pictures “AI-generated” in the workspace. Every picture you download carries a machine-readable AI-generated label (the XMP digital source type “trainedAlgorithmicMedia”) and has “ai” in its file name. Pictures are drawn only in a cartoon style, never to look like photographs.
3. Accounts
- You create an account by signing in with Google. You must be at least 14 years old.
- You may not lend or sell your account and are responsible for activity under it.
- You may ask us to delete your account at any time at contact@makingsoulstudio.com. The procedure is described in section 3 of the Privacy Policy.
- If a user under 19 made a paid purchase without a legal guardian’s consent, the user or the guardian may cancel that contract, except in cases the law excludes (such as payment from money the guardian allowed the user to spend). To cancel, email contact@makingsoulstudio.com with the sign-in email and the payment receipt.
4. Credits
- Scripts and pictures use credits. Current costs: a comic script 5, one picture (cover, panel or redraw) 10, a pet profile character drawing 10 plus 3 per photo. The cost is shown before you generate.
- New accounts receive trial credits once; the amount is shown on the pricing page.
- Plan credits are added every month while you are subscribed (yearly plans receive the first month’s credits at payment, then one month’s credits each month, 12 times). Unused plan credits roll over up to three times your monthly allowance and expire when the subscription ends.
- Top-up packs are available to subscribers only. Top-up credits do not expire and remain after a subscription ends. Plan credits are used first, then top-up credits.
- If a script or picture clearly fails because of a server error, the credits for it are returned.
- Credits cannot be exchanged for cash or transferred to another account.
5. Prices and Payment
- Plans and prices are listed in US dollars on the pricing page (mypettoon.com/pricing/).
- Our order process is conducted by our online reseller Dodo Payments, which is the Merchant of Record for all our orders. The reseller’s name is shown at checkout and on your receipt. The reseller handles payments, tax, receipts, order inquiries and returns, and its buyer terms also apply to your purchase. The Company never receives or stores your card details.
- Subscriptions renew automatically at the same interval (monthly or yearly) until cancelled.
- Before raising a subscription price, we will tell you, at least 30 days before it applies, the date of the change, the price before and after, and the payment method, and ask for your consent. We will also tell you how to cancel and what cancelling means. We will not charge the higher price to anyone who does not consent; their subscription ends at the end of the current billing period. Price decreases are announced and apply from the next renewal.
- Refunds and cancellations follow the Refund & Cancellation Policy.
6. Generated Content and Usage Rights
- To the extent permitted by law, you own the scripts, pictures and downloaded comics you create with the Service (“Outputs”). The Company handles Outputs only as needed to provide the Service (storage, display, troubleshooting).
- Free accounts and the Basic and Plus plans may use Outputs for personal, non-commercial purposes. Posting comics of your own pet on your own social media accounts is included.
- The Pro plan may also use Outputs for commercial purposes such as advertising, merchandise and commissioned work. Outputs made while on Pro may still be used commercially after the subscription ends.
- Pictures downloaded on a free account or the Basic plan carry a MyPetToon watermark, which you agree not to remove or hide.
- You keep the rights to, and are responsible for, the photos and text you put into the Service (“Uploads”). You must have the right to use your Uploads, and you may upload photos of people only with their consent, or with a parent’s or guardian’s consent for children under 14. The Company handles Uploads only as needed to provide the Service (storage, drawing your pet’s character).
- Pictures you make are served at addresses with names that cannot be guessed; anyone who has the address can view the picture without signing in. Photos you upload are never published at any address.
- AI may produce similar results for different users. The Company does not warrant that Outputs are unique or do not infringe third-party rights; you are responsible for clearing rights (likeness, trademarks, copyright) before publishing or selling Outputs.
7. Prohibited Use
- Creating or uploading content that is unlawful or infringes others’ rights (copyright, likeness, personal data, etc.)
- Creating sexual content involving minors, content that glorifies animal cruelty, or content that impersonates or deceives about real people
- Removing or hiding the AI-generated label or generation information of Outputs in order to pass them off as real photos or footage
- Excessive automated use of the Service, or circumventing credit and usage limits
- Probing the Service’s security or attempting to access other users’ accounts or data
We may restrict use or suspend an account after notice when prohibited use is confirmed, or immediately with prompt notice when urgent harm is likely.
8. Changes and Discontinuation
We may change features or discontinue the Service. We will give paid users at least 30 days’ notice of adverse changes or discontinuation, and handle remaining paid periods and unused top-up credits under the Refund & Cancellation Policy.
9. Limitation of Liability
- The Company is not liable for damage caused by events beyond its control, such as natural disasters, or by outages of third-party services (Google, Cloudflare, Supabase, OpenAI, Anthropic, our online reseller) in which the Company has no intent or negligence.
- Where the Company is at fault through intent or negligence, it is liable as required by law.
- Refunds and compensation when an outage prevents you from using paid features follow the Refund & Cancellation Policy and applicable law, regardless of this section.
10. Governing Law and Disputes
These terms are governed by the laws of the Republic of Korea. This does not take away the protection that mandatory consumer laws of your country of residence give you. Please contact contact@makingsoulstudio.com first; lawsuits go to the court designated by applicable law (including Article 36 of the Korean Act on Consumer Protection in Electronic Commerce).
11. Changes to These Terms
We will announce changes on the Service at least 7 days before they take effect (30 days if the change is adverse to users).
